Welcome to Naughty Binodini (“we,” “us,” “our”). By accessing or using www.naughtybinodini.com (the “Website”), placing an order, or interacting with our services, you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the Website.
1) Eligibility and Account Responsibility
- You confirm you are legally able to enter into a binding agreement under applicable law.
- If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- We may suspend or terminate accounts that appear fraudulent, abusive, or harmful to our business.
2) Products, Listings, and Availability
- Naughty Binodini sells creative products which may include (but are not limited to) printed goods, merchandise, stationery, art products, and/or digital creative items.
- Product images are for representation. Colors may vary slightly due to screen settings and printing processes.
- Availability is not guaranteed. We reserve the right to limit quantities, discontinue products, or modify product details at any time without liability.
3) Pricing, Taxes, and Payments
- All prices are displayed on the Website and are subject to change without prior notice.
- Prices may be inclusive or exclusive of applicable taxes depending on how the product is listed. The final payable amount will be shown at checkout.
- Payment must be completed in full before an order is processed.
- Payments are handled through third-party payment gateways. We do not store your full card details.
Important: If a payment is successful but the order is not confirmed due to a technical issue, please contact us at team.naughtybinodini@gmail.com with proof of payment. We will verify and either confirm the order or process a refund where applicable.
4) Order Confirmation, Cancellation, and Modifications
A) Order confirmation
- You will receive an order confirmation via email/SMS/WhatsApp (as applicable) once payment is successfully received and the order is accepted.
B) Cancellations by customer
- Orders may be cancelled only before dispatch/processing begins.
- Once an order is processed, printed, personalized, packed, or dispatched, it cannot be cancelled.
C) Modifications
- Changes to address, phone number, customization inputs, or order items are allowed only before processing begins.
- Naughty Binodini is not responsible for mistakes made by the customer in entering shipping details or customization content.
5) Shipping, Delivery, and Tracking
- Shipping timelines are estimates and may vary due to logistics delays, weather, strikes, peak season loads, or other reasons beyond our control.
- Delivery partners may attempt delivery multiple times. If delivery fails due to incorrect address, customer unavailability, refusal, or unreachable phone number, reshipping costs may apply.
- If tracking shows “Delivered” but you claim non-receipt, you must notify us within 48 hours. We will raise an investigation with the courier, but final resolution may depend on the courier’s proof-of-delivery.
6) Returns, Exchanges, and Refund Policy (Protective but Fair)
Because many Naughty Binodini products are creative, limited-run, and/or made-to-order, we follow these rules:
A) No returns for these cases
We do not accept returns or refunds for:
- Change of mind
- Color difference due to screen/lighting
- Minor print placement variations that do not affect usability
- Wrong address/phone provided by customer
- Delivered orders where the package was accepted by the customer/receiver/security/neighbor
- Products marked as “final sale”, “limited edition”, or “non-returnable”
- Any personalized/customized/printed-on-demand product (unless defective)
B) Returns allowed only for damaged/defective/wrong items
A return/replacement may be approved only if:
- You received the wrong item, or
- The product arrived damaged, or
- There is a manufacturing defect
Reporting window: within 48 hours of delivery
You must share:
- Clear unboxing video (recommended)
- Photos of the outer packaging + shipping label + product damage/issue
If approved, we will offer one of the following at our discretion:
- Replacement (preferred)
- Store credit
- Refund (only if replacement is not possible)
Refunds (if approved) are processed to the original payment method within typical banking timelines.
7) Digital Products / Downloads (If Applicable)
If any product is digital:
- Digital purchases are generally non-refundable once delivered/downloaded, unless required by law or unless the file is proven defective/unusable.
- You may not share, resell, redistribute, or upload the digital product anywhere.
8) Intellectual Property — Our Biggest “No Touch” Zone
Everything on this Website—including designs, illustrations, characters, brand visuals, product concepts, text, product images, logos, videos, and digital assets—is owned by or licensed to Naughty Binodini and is protected by intellectual property laws.
You may not:
- Copy, replicate, trace, modify, or recreate our designs/products
- Use our images/content for your own commercial use
- Resell Naughty Binodini designs in any form
- Create “lookalike” products and pretend it’s inspired (it’s not, it’s theft)
We will take legal action if we find copying, unauthorized commercial use, or brand impersonation.
9) User Content, Reviews, and Public Submissions
If you post a review, comment, tag us, or share content with us:
- You confirm the content is yours and doesn’t violate anyone’s rights.
- You grant Naughty Binodini a non-exclusive right to use it for marketing (social posts, website, ads), unless you explicitly request otherwise in writing.
We reserve the right to remove misleading, abusive, or spam content.
10) Prohibited Conduct (Translation: Don’t be that person)
You agree not to:
- Attempt to hack, disrupt, scrape, or overload the Website
- Use fake orders, fake disputes, or chargebacks with bad intent
- Abuse customer support or make threats
- Misuse coupons, referral codes, or payment loopholes
- Impersonate Naughty Binodini or its team
We reserve the right to cancel orders, block accounts, and pursue legal remedies in such cases.
11) Promotions, Coupons, and Offers
- Discount codes are subject to expiry, product eligibility, and availability.
- One offer may not be combined with another unless explicitly stated.
- We can cancel or reverse a discount if misuse or fraud is detected.
12) Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect damages, loss of profits, or business loss arising from use of the Website or delays beyond our control.
- Our maximum liability in any situation is limited to the amount you paid for the specific order in dispute.
13) Force Majeure
We are not responsible for failure to perform obligations due to circumstances beyond our control (including courier disruptions, government restrictions, natural disasters, strikes, internet outages, etc.).
14) Termination
We may suspend or terminate access to the Website, accounts, or services at our discretion if:
- These Terms are violated
- Fraudulent or abusive activity is suspected
- Business safety requires it
15) Governing Law and Jurisdiction
These Terms are governed by the laws of India.
All disputes shall be subject to the jurisdiction of courts located in [ Kolkata, West Bengal].
